Resolution
Regarding the Procedure for the Enforcement of
the Law on Spheres of Business Activity wherein
Foreign Investment is Prohibited or Limited
The Supreme Council of the Republic of Lithuania resolves:
1. The Law on Spheres of Business Activity wherein Foreign
Investment is Prohibited or Limited shall enter into force from
the date of its adoption.
2. To establish that prior to the adoption of the law on
monopoly activities, firms producing not less than 50 percent of
the total amount of any product which is manufactured in the
Republic, and firms which operate functioning networks of
communications, electricpower transmission, gas, oil, water
supply, heating and sewage shall be considered firms enjoying a
monopoly.
3. Upon re-registration, the activity of foreign capital
firms and joint ventures which had been functioning prior to the
date of the entry into force of the Law on Foreign Investment in
the Republic of Lithuania must be in compliance with the Law of
the Republic of Lithuania on the Spheres of Business Activity
wherein Foreign Investment is Prohibited or Limited.
4. Prior to the adoption of the Law on Land, plots of land
shall be leased to foreign capital firms and joint ventures by:
the local government board of a district (region) or town,
when the total area of the plot of land does not exceed 10
hectares in a rural area and 2 hectares in a town;
the Government of the Republic of Lithuania in coordination
with the local government board of a district (region) or town,
when the total area of the plot of land exceeds 10 hectares in a
rural area and 2 hectares in a town, or exceeds 25 kilometers in
width in a seaside or resort area.
It shall be prohibited to lease plots of land in areas
currently under state protection or in areas which are in the
process of being put under state protection.
The Government of the Republic of Lithuania shall establish
a more detailed procedure for the leasing of plots of land.
