LAW
On the Contracts and Property Unlawfully Possessed by the USSR
Military Units and other Military Structures on the Territory of
the Republic of Lithuania
Article 1. All the resolutions, decrees, directives of the
USSR, the Lithuanian SSR, Lithuanian SSR local state power and
government bodies as well as contracts forced upon the Republic
of Lithuania and binding on the State of Lithuania, on the
transference or assignment of property - land, forests, water
bodies, buildings, structures, and plants, together with their
equipment and stock, which used to be possessed by legal and
natural persons by the right of ownership on the territory of the
Republic of Lithuania, are null and void, and invalid from the
day of their enactment. They do not impose any liabilities upon
the Republic of Lithuania, its state power and government
establishments, other legal and natural persons.
Article 2. All buildings, structures, establishments
together with their equipment and stock as well as other property
of the USSR military units, military enterprises or the property
acquired or created on the territory of the Republic of Lithuania
by other USSR organisations and structures related with the
existence or servicing of military enterprises, shall become
the property of the Republic of Lithuania.
Article 3. Former contracts on sale, lease, or transference
of property specified in Articles 1 and 2 hereof, to legal or
natural persons, with the exception of contracts under which the
Republic of Lithuania - its enterprises, organisations or
governmental institutions -acquire the property, as well as
agreements or decrees on the participation of the USSR military
units, military enterprises, or other USSR organisations or other
structures related with their existence or servicing, in economic
or commercial associations, on the establishment of joint
ventures, as well as other agreements or decrees changing
property relations or violating property rights of the Republic
of Lithuania, shall be invalid from the moment of their
conclusion or enactment.
Article 4. The Government of the Republic of Lithuania, its
central and local institutions of state power and government, as
well as enterprises, institutions or organisations shall be
prohibited to conclude any contracts or to otherwise assume
obligations regarding sale, lease or transference of land,
forests, water bodies, buildings, structures or other
establishments owned by the Republic of Lithuania, to the USSR
military units or the USSR organisations or other structures
related with their existence or servicing.
Provided such contracts are concluded, they shall be held
invalid from the moment of their conclusion.
Article 5. All obligations regarding the fulfillment of the
requirements of the USSR military units and the USSR
organisations or other structures related with their existence
and servicing, imposed upon the Republic of Lithuania by force,
shall be held void and null and having no legal force.
Rendering of services for the USSR military units and the
USSR organisations and other structures related with their
existence, as well as the compensation for damages which has been
inflicted or continue to be inflicted to the legitimate owner,
cannot serve as a legal presumption for justifying the temporary
existence of these structures and the management of property
specified in Articles 1 and 2 in Lithuania.
Damage, which has been inflicted or continues to be
inflicted by the USSR military units, military enterprises and
other USSR military structures by unlawful management and use of
the property possessed by the right of ownership by legal or
natural persons of the Republic of Lithuania, or by their
engagement in economic activities as well as incurred losses or
unreceived profit shall be assessed in the manner established by
the laws of the Republic of Lithuania and by experts'
calculations.
Article 6. The Government of the Republic of Lithuania shall
start immediately the implementation of this law by establishing
the procedure for the taking over of the property and shall carry
out the taking over of the said property. The Government shall
restore and safeguard the property interests of the Republic of
Lithuania and of its legal and natural persons, shall solve the
issues relative to the disposal and use of the said property.
On the decision of the Government, the property specified in
Articles 1 and 2 may be used for the establishment of all types
of enterprises set forth in the laws of the Republic of
Lithuania. It may be transferred into the possession of public or
private enterprises; investments may be used in the established
manner and as necessary, the type of an enterprise which has been
taken over shall not be changed.
The housing fund belonging to the USSR military units,
military enterprises, organisations and other structures shall be
at the disposal of and shall be privatized by the local
governments of towns and districts according to the procedure
provided for in the laws of the Republic of Lithuania.
Article 7. For the hampering the taking over of the property
specified in Articles 1 and 2 hereof, its destruction, taking
away, illegal transference, ruining, or any other damage,
officers of the USSR military units, enterprises, organisations
or other structures, as well as other persons shall be subject
to liability under the laws of the Republic of Lithuania.
Article 8. This law shall come into force from the moment of
its enactment.
